TERMS AND CONDITIONS

IMPORTANT NOTICE CONCERNING LIMITATIONS OF LIABILITY BY THE CONDITIONS SET OUT BELOW (THE CONDITIONS) GREYHOUND COURIERS (THE CARRIER ) AND THE AGENTS OF AND PERSONS EMPLOYED BY OR UNDER CONTRACT WITH THE CARRIER,

1 )SHALL NOT BE LIABLE IN ANY WAY FOR CERTAIN LOSSES AND DAMAGE;

2) WHERE THEY SHALL, BE LIABLE FOR LOSSES AND DAMAGE THEIR LIABILITY THEREFORE SHALL NOT EXCEED 5,000 POUNDS PER VAN CONSIGNMENT OR 500 POUNDS PER MOTORCYCLE CONSIGNMENT ALL ITEMS CARRIED ON OUR OVERNIGHT SERVICE ARE INSURED AT 100 POUNDS PER CONSIGNMENT.

The Carrier accepts goods for carrlage subject to the conditions and each condition shall be deemed to be incorporated in and to be a condition of any agreement between the Carrier and the customer.

No agent of or person employed by or under contract with the Carrier has no authority to alter or vary in any way the conditions unless he is first expressly authorized in writing by the Carrier to make the particular alteration or variation

1. DEFINITIONS In the conditions the following expressions shall have the following meanings

(a) Carrier means and (unless the context otherwise requires) includes the Carriers servants agents and any person or persons carrying goods under any contract with the carrier or such a person or persons

(b) Customer means any person who contracts for the service of the carrier and includes the Customers servants or agents

(c) Package means an outer container containing either unpacked items or any number of smaller containers

(d) Consignment means one or more Packages collected by the Carrier from one or more addresses and carried by the Carrier together (in the case of more than one package) in one load on one motorcycle or in one vehicle from one customer to one or more addresses

(e) Excepted Goods means (1) Goods which are specified in the special classifications of dangerous goods issued by The British Railways Board for conveyance on the ground of thair dangerous or hazardous nature and; (2) Goods which though not included in (1) above are of a kindred nature and; (3) Bills of exchange promissory notes money securities for precious stones jewelry and bullion. (4) Contract shall mean the contract of carriage between the Customer and the Carrier.

2. CARRIER IS NOT A COMMON CARRIER The Carrier is not a common carrier and will accept goods for carriage only subject to conditions

3. PARTIES AND SUB-CONTRACTING a) Every Customer entering into a Contract shall be deemed to be either the owner or the authorized agent of the owner of every Consignment and every constituent part thereof to which the Contract relates as regards the making of the Contract the acceptance of the Conditions and all matter of every nature arising thereout and shall also be deemed to be authorlzed to accept the Conditions on the behalf of all other persons who are or may thereafter become interested in the subject matter of the contract. (b) The Carrier reserves the right at its absolute discretion to fulfill any Contract either in whole or in part by its own senvants or agents or by instructing or entrusting the fulfilling thereof either in whole or in part to others. (c) The Carrier makes the Contract on his behalf and as agent for any other person who is entrusted to fulfill the Contract under clause 3(b) above Any such person shall be entitled to the benefit of the Contract and shall be under no liability whatsoever to the Customer or anyone claiming through or under him in respect of the subject matter thereof otherwise than in accordance with the conditions

4. EXCLUSION OF LIABILITY (a) IN NO EVENT:SHALL THE CARRIER BE LIABLE FOR ANY SPECIAL OR CONSEQUENTIAL DAMAGES OR OTHER INDIRECT LOSS, however arising including but not limited to, loss of business, income, profits, interest, utility, loss of a market, or other commercial or financial losses, whather or not the Carrier had knowledge that such demages might be incurred. (b) The Carrier will try to take all necessary steps to effect the prompt delivery of all Consignments but WILL NOT BE LIABLE FOR DELAY IN CARRYING OR DELIVERING ANY IMPORTANT CONSIGNMENT UNDER ANY CIRCUMSTANCES (c) Without prejudice to the forgoing the Carriers shall not be liable for any loss non-delivery or misdelivery of or damage to a consignment or any part thereof which arises.

(1) Wear and tear moths vermin depreciation delay or natural deterioration

(2) Act of god force majeure earthquake war innovation act of foreign enemy hostilities (whether war be declared or not) civil war rebellion revolution insurrection or military or insured power not strike or civil commotion.

(3) lonizing radiation's or contamination by radio activity from any nuclear fuel or from any nuclear waste from the combustion of nuclear fuel

(4) Radioactive toxic explosive or other hazardous properties of any explosive nuclear assembly or nuclear component thereof:

(5) Insufficient or improper packing

(6) Insufficient or improper labeling or addressing

(7) Theft pilferage or any attempt thereof from any unattended motorcycle or other vehicle

(8) Consignee not taking or accepting delivery within a reasonable time

(9) Fraud on the part of the Customer the consignee or the owner of the of the consignment or any part thereof or the servants or agents of any of them in any respect of that consignment

5. CARRIERS CHARGES Invoices are rendered weekly payment is due within thirty days of submission Account queries will only be considered if raised within our thirty day credit terms The Carrier reserves the right to charge for cancelled consignments to the full rate of the vehicle required

6. LAW These conditions shall be governed by English law and any dispute relating thereto shall be within exclusive jurisdiction of the English courts.
